This English version prevails over the French version (Conditions générales d'utilisation) in case of discrepancy, unless the law applicable to the user requires the French version.
1. Who we are
ABRH is architecture software published by ABRH OR LLC, a limited liability company organized under the laws of the State of Florida (United States), registration number [SUNBIZ NUMBER], with its principal office at 1056 Euclid Avenue, Miami Beach, FL 33139, United States ("ABRH", "we", "us").
To contact us:
- questions about these Terms: legal@abrh.app;
- help and support: support@abrh.app;
- personal data: privacy@abrh.app;
- billing and subscriptions: billing@abrh.app.
2. Purpose and acceptance
2.1. These Terms of Service (the "Terms") govern your use of:
- the ABRH desktop software (macOS and Windows), its updates and test versions (the "Software");
- the online services that come with it: user account, artificial intelligence assistant, subscriptions, emails, support (the "Services");
- the abrh.app website (the "Site").
Together, the Software, the Services and the Site make up the "Platform".
2.2. By creating an account, ticking the acceptance box or using the Platform, you accept these Terms and the Privacy Policy, which forms part of them. If you use ABRH on behalf of a firm, a school or another organization, you represent that you are authorized to bind it, and "you" also refers to that organization.
2.3. If you do not accept these Terms, do not install the Software and do not use the Platform.
3. Eligibility
3.1. Minimum age. The Platform is reserved for people at least 13 years old. In the European Union and in countries where the age of digital consent is higher (15 in France, for example), a younger user must obtain authorization from a parent or legal guardian. The date of birth requested at sign-up is used only to check this age.
3.2. Requirements. The Software requires a compatible computer and an internet connection to create an account, sign in, use the AI assistant and manage subscriptions. Modeling, drawing and rendering run on your computer, including offline for an account that is already signed in.
3.3. Export control. You represent that you do not reside in a country subject to a United States embargo and are not on any list of sanctioned persons. You agree not to export or use the Platform in violation of applicable export control laws.
4. User account
4.1. Creation. An account is required to use the Software. You provide accurate, up-to-date information: first name, last name, date of birth, email address and profession. Your address is confirmed by a code sent by email.
4.2. One account, one person. Your account is personal. It may not be shared, lent or resold. A firm wishing to equip several team members opens one account per person.
4.3. Security. You choose a password of at least 8 characters and keep it secret. You are responsible for all use of your account. Let us know promptly at support@abrh.app of any unauthorized use. We notify you by email of any sign-in from a new computer and of any password change.
4.4. Deletion. You may delete your account at any time from the Software. Deletion is permanent: it erases your account data from our servers (subject to the legal retention periods described in the Privacy Policy) and immediately cancels any subscription, without refund of the current period unless the law provides otherwise. Your projects saved on your computer are not affected; their online copies are erased.
4.5. Usage statistics. To improve ABRH, the Software measures your usage: active usage time (in 5-minute slices, while the Software is in the foreground and in use) and the number of projects created and opened, files saved and imports, with their type. Never the content of your projects. These measurements are used only for aggregate statistics; they are not sold, shared or used for advertising. They are on by default and you may turn them off at any time in ABRH › My account › Privacy, without affecting the rest of the service; measurement stops immediately. Details are in the Privacy Policy (section 3.4).
5. Software license
5.1. License. Subject to your compliance with these Terms, ABRH grants you a personal, worldwide, non-exclusive, non-transferable, non-assignable and revocable license to install and use the Software, for professional or personal purposes, on the computers you use. The Software is licensed, not sold.
5.2. Free of charge. Use of the Software is free. Certain features, in particular the AI assistant beyond the volume included in the free plan, require a paid subscription (Section 8).
5.3. Restrictions. Except to the extent the law expressly permits it notwithstanding this prohibition, you agree not to:
- copy, modify, translate, adapt or create derivative works of the Software;
- decompile, disassemble, reverse engineer the Software or attempt to extract its source code;
- rent, sell, sublicense, distribute or make the Software available to third parties, including as an online service;
- circumvent, disable or tamper with technical measures: account, session checks, quotas, credits, usage limits;
- use the Services beyond their normal use through the Software, in particular by calling our servers or the AI assistant directly from another program;
- remove or alter proprietary, trademark or license notices;
- use the Platform to build a competing product, or to benchmark it for publication without our written consent.
5.4. Third-party components. The Software includes open source components distributed under their own licenses, listed in the Software together with their texts. Those licenses prevail over these Terms for the components concerned.
5.5. Updates. We may release updates that fix, improve, add or remove features. Some updates may be required to keep using the Services. These Terms apply to all versions.
5.6. Test versions. Versions identified as "beta", "preview" or "test" are provided for evaluation. They may contain errors, be changed or discontinued at any time, and should not be used for critical work without backups.
6. Your projects and content
6.1. Ownership. You remain the sole owner of your projects, models, drawings, plans, images, imported files and anything you create with ABRH (the "Content"). ABRH claims no rights in it.
6.2. Stored on your computer and online. Your projects are saved on your computer and in the files you choose to save. They are not sent to our servers, except for the elements transmitted to the AI assistant when you use it (Section 7) and the projects for which you tick “Sync”: a copy is then kept in your account, within the storage space of your plan, so that you find them on your other devices. The online copy is not a guaranteed backup: in case of a conflict between two devices, you choose which version is kept. You are responsible for backing them up. ABRH cannot be held liable for data loss caused by a computer failure, a mistake or a Software error; we encourage you to save your projects to files regularly and back them up.
6.3. Limited license. Solely to the extent necessary to operate the Services (for example to send your request and the state of your model to the AI assistant), you authorize us to receive, transmit and process your Content, on your behalf and only to provide the service you requested. This authorization ends once processing is complete. We do not use your Content to train artificial intelligence models.
6.4. Warranties. You represent that you hold the necessary rights to the Content you import or submit to the AI assistant (plans, images, third-party files), and that its use does not infringe anyone's rights.
7. Artificial intelligence assistant
7.1. How it works. The AI assistant helps you model, edit, analyze and document your project. When you ask it something, your request, the current conversation and a description of your model (layers, objects, dimensions) are sent, through our servers, to our AI model provider, which processes them to produce the answer. Changes suggested by the assistant appear as proposals that you accept or decline.
7.2. Reliability of results. The assistant's answers and proposals are generated automatically. They may be inaccurate, incomplete, or unsuited to your project or to local regulations. You alone judge their relevance and must check them before use, especially for anything relating to structure, safety, accessibility or regulatory compliance.
7.3. Credits. Using the assistant consumes credits, counted according to the computing volume actually used by each request. Your plan includes a number of credits per period; once they are used up, the assistant is suspended until the period renews or until you upgrade. Credits do not roll over, are not transferable and have no cash value.
7.4. Acceptable use. You agree not to use the assistant to produce unlawful, misleading, hateful or violent content, content that infringes the rights of others, or to try to circumvent its limits or safety rules. You also comply with the usage policies of our AI model provider, which we will provide on request. We may suspend access to the assistant in case of abuse.
7.5. Availability. The assistant relies on third-party services. It may be temporarily unavailable, slower or changed (for example a change of model) without entitling you to compensation, subject to Section 8.8.
8. Subscriptions, payment and refunds
8.1. Plans. The Software is free, without the AI assistant. ABRH offers paid plans (Doric, Ionic and Corinthian), billed monthly or yearly, which give access to the AI assistant. Their content (AI credits, available AI models, online project storage) and price are shown in the Software and on the Site at the time of purchase.
8.2. Prices and taxes. Prices are in US dollars. Applicable taxes (sales tax, VAT or equivalent) may be added depending on your country and status; they are calculated by Stripe and the amount is shown before payment.
8.3. Payment and seller. Subscriptions are sold through Stripe, which acts as reseller and merchant of record: Stripe collects the payment, calculates, collects and remits applicable taxes, and issues your invoice. Stripe may handle certain refund requests directly, within the limits of its own terms. ABRH never has access to your card numbers. By subscribing, you authorize the charge of the chosen plan's price at purchase and at each renewal. ABRH remains responsible for the Software and the AI assistant it provides.
8.4. Automatic renewal. Subscriptions renew automatically for the same duration (one month or one year) until cancelled. For yearly subscriptions, we send a reminder before renewal where the law requires it.
8.5. Cancellation by you. You may cancel your subscription at any time from the Subscription screen of the Software (secure customer portal). Cancellation takes effect at the end of the current, already paid period: until then you keep your plan and its credits, then you automatically return to the free plan.
8.6. Changing plans. Upgrades take effect immediately; the price difference is prorated over the remaining period. Downgrades take effect at the end of the current period.
8.7. Failed payments. If a payment fails, we and our payment provider notify you and retry the charge. If it is not resolved, the subscription is suspended then cancelled, and the account returns to the free plan.
8.8. Refunds. Unless the law provides otherwise, amounts paid are non-refundable, and no partial period is refunded pro rata. In case of a prolonged interruption of the AI assistant caused by us, we may grant credits or another goodwill gesture at our discretion.
8.9. No right of withdrawal. A subscription gives immediate access to the AI assistant and its credits, which are digital content and digital services supplied as soon as the subscription is activated and which cost ABRH real money from their first use. At checkout, you expressly request that your subscription start immediately, before the end of the 14-day withdrawal period, and you acknowledge that you thereby lose your right of withdrawal (Article 16(a) and (m) of Directive 2011/83/EU and the national laws implementing it, such as Articles L221-25 and L221-28 of the French Consumer Code). As a result, an activated subscription cannot be withdrawn from or refunded, in whole or in part, including when credits have not been fully used. You may, however, cancel it at any time for future periods (section 8.5).
8.10. Price changes. We may change our prices. Any increase applies from the next renewal, after at least 30 days' notice by email. You may cancel before it takes effect.
9. Important professional disclaimer
9.1. ABRH is a design aid. The checks and estimates provided by the Software and the AI assistant (structural feasibility, sections and spans, thermal performance, insulation, regulatory compliance, building permit procedures, cost estimates, sunlight, quantities) are indicative. They rely on simplified assumptions, average values and only the information contained in the model.
9.2. These results in no way replace the advice, calculations and responsibility of an architect, a structural engineer, a building energy consultant, a cost estimator, an inspector or the competent authorities. Any project intended to be built must be checked, designed and signed by licensed professionals, in accordance with applicable laws and regulations.
9.3. You alone are responsible for how you use the plans, documents and information produced with ABRH, for their compliance with zoning and building rules, and for the consequences of their use.
10. ABRH intellectual property
The Software, the Services, the Site, their code, interface, libraries (materials, assemblies, furniture, sheet templates), texts, images and the ABRH trademark are the property of ABRH OR LLC or its licensors and are protected by intellectual property laws. Apart from the license in Section 5, no rights are granted to you. Library items (furniture, materials, assemblies) may be used freely in your projects and in the documents you derive from them.
11. Feedback
If you send us ideas, suggestions or feedback about ABRH, you allow us to use them freely, without compensation and without any obligation to implement them.
12. Third-party services
The Platform relies on providers (hosting, artificial intelligence, payment, email) described in the Privacy Policy. Links to third-party sites do not imply endorsement of their content; their use is governed by their own terms.
13. Availability and support
We strive to keep the Services available at all times but cannot guarantee it: maintenance, updates, provider outages or force majeure may interrupt them. Support is provided by email at support@abrh.app within a reasonable time.
14. Suspension and termination by ABRH
14.1. We may suspend or close your account, with or without notice depending on the seriousness, in case of breach of these Terms, fraud, non-payment, threat to the security of the Platform, or at the request of an authority.
14.2. We may also discontinue the Platform or some of its features. In that case, we will notify you at least 60 days in advance and refund, pro rata, any paid and unused subscription period.
14.3. Sections 6.1, 9, 10, 15, 16, 17 and 19 survive the end of the relationship.
15. Warranties
15.1. To the fullest extent permitted by law, the Platform is provided "as is" and "as available", without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, error-free operation or non-infringement.
15.2. If you are a consumer, you keep the statutory warranties granted by the law of your country of residence that cannot be waived (for example, in France, the statutory conformity warranty for digital content and services).
16. Limitation of liability
16.1. To the fullest extent permitted by law, ABRH will not be liable for any indirect, special, incidental or consequential damages, or for loss of data, projects, profits, revenue, goodwill or opportunities, arising from the use of or inability to use the Platform, even if advised of their possibility.
16.2. To the fullest extent permitted by law, ABRH's total liability relating to the Platform is limited to the greater of: the amounts you actually paid us in the twelve months preceding the event giving rise to liability, or fifty US dollars ($50).
16.3. These limitations do not apply in case of gross negligence or willful misconduct, personal injury, or where applicable law prohibits limiting liability, in particular toward consumers.
17. Indemnification
If you use ABRH professionally, you will defend and indemnify ABRH against any third-party claim arising from your Content, from your use of documents produced with ABRH, or from your breach of these Terms, including reasonable costs.
18. Changes to these Terms
We may change these Terms, for example to reflect changes to the Platform or the law. For material changes, we will notify you at least 30 days in advance, by email or in the Software. If you keep using the Platform after the new Terms take effect, you accept them; otherwise, you may delete your account and cancel your subscription.
19. Governing law and disputes
19.1. These Terms are governed by the laws of the State of Florida (United States), without regard to its conflict of laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
19.2. In case of a dispute, please write to us first at legal@abrh.app: most issues can be resolved informally. If no agreement is reached within 60 days, the dispute falls under the exclusive jurisdiction of the courts of Miami-Dade County, State of Florida.
19.3. If you are a consumer residing in the European Union or in another country that grants you mandatory protections, you keep the benefit of those protections and the right to bring proceedings before the courts of your country of residence. European Union consumers may also use a consumer mediator free of charge: [MEDIATOR NAME AND CONTACT].
20. Miscellaneous
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and ABRH regarding the Platform.
- Severability. If a provision is held invalid or unenforceable, the others remain in effect.
- No waiver. Failure to enforce a right is not a waiver of that right.
- Assignment. You may not assign your rights without our consent. We may assign ours in connection with a merger, acquisition or sale of business, with notice to you.
- Force majeure. Neither party is liable for a failure caused by an event reasonably beyond its control.
- Electronic communications. You agree to receive information about your account and these Terms by email or in the Software.
- Language. These Terms exist in English and in French. In case of discrepancy, the English version prevails, unless applicable law requires the French version.
